Despite legal battles more than two-thirds of Brazilan states are still enforcing the legislation<\/h2>\n<p style=\"text-align: center;\">by Matteo Cavallito<\/p>\n<p>&nbsp;<\/p>\n<p>Since April 2020, Brazil&#8217;s native peoples have lost more than <strong>250,000 hectares<\/strong> of land under the pressure of acquisitions by private companies according to a report <a href=\"https:\/\/news.mongabay.com\/2022\/07\/under-bolsonaro-policy-invaders-seize-control-of-250000-hectares-of-indigenous-lands\/?utm_medium=Social&amp;utm_source=Twitter#Echobox=1657187074-1\" target=\"_blank\" rel=\"noopener\">quoted<\/a> by the U.S.-based NGO Mongabay. The investigation focuses on a regulatory reform supported by President <strong>Jair Bolsonaro<\/strong>: the so-called <a href=\"https:\/\/www.in.gov.br\/web\/dou\/-\/instrucao-normativa-n-9-de-16-de-abril-de-2020-253343033\" target=\"_blank\" rel=\"noopener\">Normative Instruction Number 9<\/a> for the &#8220;regulation of the requests, analysis and issuance of the Declaration of Recognition of Boundaries in relation to private property.&#8221;<\/p>\n<p>In the past, says <strong>Mongabay<\/strong>, applications for land registration of new properties located in indigenous territories were automatically rejected. The new legislation, passed on April 16 two years ago, now allows large landowners &#8220;to obtain <strong>federal property certificates<\/strong> for areas in any Indigenous territory that has not been officially recognized, or demarcated.&#8221;<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Under Bolsonaro policy, invaders seize control of 250,000 hectares of Indigenous lands <a href=\"https:\/\/t.co\/snsfigXlCA\">https:\/\/t.co\/snsfigXlCA<\/a><\/p>\n<p>&mdash; Mongabay (@mongabay) <a href=\"https:\/\/twitter.com\/mongabay\/status\/1544976293602762754?ref_src=twsrc%5Etfw\">July 7, 2022<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<h5>An assist to private investors and the illegal market in Brazil<\/h5>\n<p>According to the study, carried out by GeoPrecisa, a consulting firm specializing in land tenure certification and registration systems management, the acquisition of areas made possible by the new rule has affected <strong>49 indigenous communities<\/strong> in Brazil. According to Mongabay, the law, introduced to eliminate the automatic block of applications for those lands not yet demarcated, paved the way for a large acquisition business.<\/p>\n<blockquote><p>This allowed &#8220;farmers, <strong>illegal miners<\/strong> and land grabbers to invade Indigenous lands and register the properties to themselves, including in areas whose use is restricted by Funai (Funda\u00e7\u00e3o Nacional do \u00cdndio, the Brazilian governmental protection agency for <strong>native people\u2019s<\/strong> interests and culture, ed.) in order to locate and protect <a href=\"https:\/\/en.wikipedia.org\/wiki\/Uncontacted_peoples\" target=\"_blank\" rel=\"noopener\">uncontacted Indigenous peoples<\/a>.&#8221;<\/p><\/blockquote>\n<p>In contrast to the government&#8217;s support, Brazil&#8217;s Federal Prosecutor&#8217;s Office <a href=\"http:\/\/www.mpf.mp.br\/pgr\/noticias-pgr\/mpf-atuou-atuou-contra-retrocesso-de-direitos-relativos-as-populacoes-indigenas-e-comunidades-tradicionais-e-na-cobranca-de-medidas-de-protecao-contra-a-covid-19\" target=\"_blank\" rel=\"noopener\">challenged the law<\/a>, accusing it of favoring land occupation and violating indigenous rights. Although prosecutors have filed as many as <strong>25 lawsuits<\/strong> against the rule, the new regulation <a href=\"http:\/\/www.mpf.mp.br\/pgr\/noticias-pgr\/normativa-da-funai-que-fragiliza-protecao-de-terras-indigenas-esta-suspensa-em-8-estados-da-federacao\" target=\"_blank\" rel=\"noopener\">has been suspended<\/a> in just <strong>eight states<\/strong>. Since the approval of Regulatory Instruction 9, Mongabay writes, the pace of purchases has increased. In two years, the government has certified and registered farm acquisitions on more than <strong>69 thousand hectares<\/strong>. The indigenous territories of Kanela\/Memortumr\u00e9, (with 53 thousand hectares of land registered) and Bacurizinho (23 thousand hectares) were also particularly affected.<\/p>\n<blockquote><p>Maranh\u00e3o, Mongabay says, is one of the epicenters of <strong>soybean sector <\/strong>development. Here investors, corporations and agribusiness firms are especially active in land purchases, the NGO explains.<\/p><\/blockquote>\n<p>Also problematic is the situation in the state of <strong>Mato Grosso do Sul<\/strong> where the federal government has approved the registration of more than 58 thousand hectares by farms operating in indigenous community areas. According to the latest report &#8220;<a href=\"https:\/\/www.focsiv.it\/i-padroni-della-terra-2022\/\" target=\"_blank\" rel=\"noopener\">I padroni della Terra<\/a>&#8221; (The Masters of the Earth), published in 2022 by Italian NGO <strong>Focsiv<\/strong>, the phenomenon is still <a href=\"https:\/\/resoilfoundation.org\/inchieste\/land-grabbing-accaparramento-terre-dati-2022\/\" target=\"_blank\" rel=\"noopener\">favored<\/a> by <strong>digitization<\/strong> and widespread geopolitical crises. Two years ago, in fact, territories hit by land grabbing amounted to <strong>79 million<\/strong> hectares. The main victim of the acquisitions is <strong>Peru<\/strong> with 16 million hectares, followed by <strong>Brazil<\/strong> (5.2 million hectares), Indonesia, Papua New Guinea, Argentina, South Sudan, Mozambique, Liberia and Madagascar.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In the South American country, a disputed 2020 law paved the way for the acquisition of non-demarcated indigenous lands.
