Concerns over France and Germany&#8217;s position<\/h2>\n<p style=\"text-align: center;\">by Matteo Cavallito and Emanuele Isonio<\/p>\n<p>&nbsp;<\/p>\n<p>The European Union will adopt specific legislation for <strong>soil protection<\/strong> starting with the proposed law that will be finalized by the <strong>Commission<\/strong> in <strong>2023<\/strong>. The Wednesday 17th <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_21_5916\" target=\"_blank\" rel=\"noopener\">announcement<\/a> now opens the door to the long-awaited <strong>Nature Restoration Law<\/strong> which, according to Brussels, will provide soil with the same legal protection already granted to water, air and sea, <a href=\"https:\/\/www.europarl.europa.eu\/doceo\/document\/B-9-2021-0221_EN.html\" target=\"_blank\" rel=\"noopener\">as already demanded<\/a> by the European Parliament last April.<\/p>\n<p>&#8220;Our strategy will allow the soil to become healthy, to be used in a sustainable way and to receive the legal protection it needs,&#8221; said European Commission Vice-President <strong>Frans Timmermans<\/strong>.\u00a0According to the draft plan, which sits alongside <a href=\"https:\/\/www.theguardian.com\/environment\/2021\/nov\/17\/eu-deforestation-beef-coffee-import-ban-commodities-endangered-forests\" target=\"_blank\" rel=\"noopener\">programs to tackle deforestation and promote waste recycling<\/a>, the EU plans to form a new, enlarged group of experts to develop some detailed proposals.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Today, we have adopted new proposals to: <\/p>\n<p>\ud83c\udfde\ufe0f stop deforestation<br \/>\u267b\ufe0f innovate waste management<br \/>\ud83c\udf0d make soils healthy   <\/p>\n<p>These are tools to move to a circular economy, protect nature and climate, and lift environmental standards in the \ud83c\uddea\ud83c\uddfa and the world.<a href=\"https:\/\/twitter.com\/hashtag\/EUGreenDeal?src=hash&amp;ref_src=twsrc%5Etfw\">#EUGreenDeal<\/a> <a href=\"https:\/\/t.co\/XRBqbUOYDu\">pic.twitter.com\/XRBqbUOYDu<\/a><\/p>\n<p>&mdash; European Commission \ud83c\uddea\ud83c\uddfa (@EU_Commission) <a href=\"https:\/\/twitter.com\/EU_Commission\/status\/1460944394949902343?ref_src=twsrc%5Etfw\">November 17, 2021<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<h5>&#8220;Avoid, reuse, minimise, compensate&#8221;<\/h5>\n<p>&#8220;<strong>Avoid<\/strong>&#8221; further land consumption by stopping <strong>soil sealing<\/strong> to reach net zero by mid-century. But also &#8220;<strong>reuse<\/strong>&#8220;, &#8220;<strong>minimize<\/strong>&#8221; and &#8220;<strong>compensate<\/strong>&#8220;. These are the keywords shaping the overall vision of the problem. Europe, in particular, must promote the reuse of land already occupied and, when this is not possible, minimize the impact of land consumption by choosing sites in less favorable conditions and preserving the most valuable areas (from forests to fertile land). The Commission has set three <strong>goals<\/strong>:<\/p>\n<ul>\n<li>Join the international &#8220;<a href=\"https:\/\/www.4p1000.org\/\" target=\"_blank\" rel=\"noopener\">4 per 1000<\/a>&#8221; initiative to increase soil carbon on agricultural land.<\/li>\n<li>Develop a long-term vision for sustainable carbon cycles (including CO2 <a href=\"https:\/\/resoilfoundation.org\/en\/environment\/sustainable-soil-carbon-offesetting\/\" target=\"_blank\" rel=\"noopener\">capture<\/a>, storage and use) in the direction of climate neutrality.<\/li>\n<li>Achieving zero net soil removal by 2050.<\/li>\n<\/ul>\n<p>The Soil Health Law, in short, involves several issues. According to the draft they will have to report to the Commission on their progress in reducing soil consumption.\u00a0 Moreover is always up to governments to set national targets and develop their <strong>plans for the recovery of urban soils<\/strong> according to the principles of EU legislation. The document drawn up by Brussels also includes the gradual elimination of subsidies and financial incentives not compliant with European targets like local tax benefits for the conversion of agricultural or natural land into a construction area.<\/p>\n<p>Back in 2004, the EU had already put forward a proposal for a directive on soil protection, but the initiative was blocked by opposition from five countries, Environment Commissioner <strong>Virginijus Sinkevi\u010dius<\/strong> said at a press conference.<\/p>\n<blockquote><p>&#8220;Currently, however, we are facing a completely different scenario,&#8221; he added. &#8221; Even some countries that previously opposed a soil law are now calling for it.&#8221;<\/p><\/blockquote>\n<p>The former Lithuanian Economy Minister didn&#8217;t give further details. As an example, the plan highlights the benefits of recycling organic matter &#8211; <strong>compost<\/strong>, digestate, sewage sludge, processed manure and other agricultural residues &#8211; as a basis for developing natural <strong>fertilizers<\/strong>. To ensure the safety of the production process and avoid soil pollution, the Commission will review directives that address the management of these elements. Moreover, Brussels &#8220;will assess the options for ensuring the reduction of nutrient losses by at least 50% (resulting in the reduction of use of fertilisers by at least <strong>20%<\/strong>), with a view to making this target legally binding.&#8221; Funding for a new <a href=\"https:\/\/cinea.ec.europa.eu\/life_it\" target=\"_blank\" rel=\"noopener\">LIFE<\/a> project on the use of high quality compost from organic waste is also expected.<\/p>\n<div class='avia-iframe-wrap'>\n<blockquote class=\"wp-embedded-content\" data-secret=\"Gkc9VX0zzO\"><p><a href=\"https:\/\/resoilfoundation.org\/en\/articles\/agricolture-fao-fertilizers\/\">UNEP urges a new fertilizers policy for a sustainable agriculture<\/a><\/p><\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; clip: rect(1px, 1px, 1px, 1px);\" title=\"&#8220;UNEP urges a new fertilizers policy for a sustainable agriculture&#8221; &#8212; Re Soil Foundation\" src=\"https:\/\/resoilfoundation.org\/en\/articles\/agricolture-fao-fertilizers\/embed\/#?secret=Gkc9VX0zzO\" data-secret=\"Gkc9VX0zzO\" width=\"600\" height=\"338\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/div>\n<h5>(Almost) zero soil pollution in 2050<\/h5>\n<p>Great focus also on <strong>bioplastics<\/strong>, as an alternative to traditional coatings, and on tackling pollutants. Biodegradability criteria for certain polymers, such as coating agents and agricultural <strong>mulch films<\/strong> under the EU Fertilizer Products Regulation, are to be &#8220;adopted by July 2024,&#8221; the draft states. &#8220;The contaminant limits for EU fertilising products will be reviewed by July 2026 as part of the general review of that regulation.&#8221;<\/p>\n<p>The initiatives, which include the development over the next three years of a &#8220;list for contaminants of major and\/or emerging concern that pose significant risks for <strong>European soil quality<\/strong>, and for which vigilance and priority action at European and national level,&#8221; and which will be supported by resources provided under <strong>Horizon Europe<\/strong>, CAP and LIFE and by the use of other structural funds, are expected to lead to the final goal.<\/p>\n<p>&#8220;By <strong>2050<\/strong>,&#8221; the document states, &#8220;soil pollution should be reduced to levels which are no longer expected to pose risks and which respect the boundaries our planet can cope with, thus creating a toxic-free environment.&#8221;<\/p>\n<div class='avia-iframe-wrap'>\n<blockquote class=\"wp-embedded-content\" data-secret=\"LrcHON3LGs\"><p><a href=\"https:\/\/resoilfoundation.org\/en\/articles\/fao-soil-pollution-report\/\">Allarme FAO: la contaminazione del suolo fa perdere il 20% della produttivit\u00e0 agricola<\/a><\/p><\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; clip: rect(1px, 1px, 1px, 1px);\" title=\"&#8220;Allarme FAO: la contaminazione del suolo fa perdere il 20% della produttivit\u00e0 agricola&#8221; &#8212; Re Soil Foundation\" src=\"https:\/\/resoilfoundation.org\/en\/articles\/fao-soil-pollution-report\/embed\/#?secret=LrcHON3LGs\" data-secret=\"LrcHON3LGs\" width=\"600\" height=\"338\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/div>\n<h5>Fino (Re Soil): \u201cI paesi UE possono fare un deciso passo in avanti\u201d<\/h5>\n<p>\u201cLa Soil Strategy for 2030 annunciata oggi dalla Commissione UE \u00e8 una scelta epocale, che d\u00e0 a tutti gli Stati europei la possibilit\u00e0 di fare un deciso passo in avanti a favore della cura e della tutela del suolo&#8221;, commenta <strong>Debora Fino, Presidente della Fondazione Re Soil.<\/strong> &#8220;Ma \u00e8 anche un&#8217;occasione per avviare politiche nazionali che stimolino le strategie pi\u00f9 efficaci per restituire salute ai terreni, partendo ovviamente da quelli agricoli\u201d.<\/p>\n<p>L&#8217;annuncio della Commissione, inoltre, \u00e8 rilevante per almeno tre motivi. \u201cLa comunicazione odierna riconosce i gravi problemi connessi alla mancata adozione di un quadro legale che dia al suolo <strong>la stessa protezione riconosciuta all&#8217;acqua, all&#8217;aria e all&#8217;ambiente marino<\/strong>. Inoltre, annuncia per il 2023 una legge europea per la salute del suolo che offra finalmente criteri univoci per definire degradato un terreno. In Europa abbiamo <strong>2,8 milioni di siti contaminati<\/strong>. Mentre per il 65-75% dei suoli agricoli l&#8217;apporto di nutrienti raggiunge livelli tali da creare possibile eutrofizzazione e da incidere sulla biodiversit\u00e0. Il 25% dei terreni nell\u2019Europa meridionale, centrale e orientale \u00e8 a rischio alto o molto alto di <strong>desertificazione<\/strong>. Si stima che i costi associati al degrado del suolo nell\u2019UE superino i 50 miliardi di euro all\u2019anno.<\/p>\n<p>\u201cQuei numeri dimostrano l&#8217;estrema urgenza di intervenire\u201d conclude Debora Fino. \u201cLa Commissione oggi ha fatto un primo, importante passo. Questa opportunit\u00e0 ora deve essere colta dagli Stati membri, a partire dall&#8217;Italia, per introdurre rapidamente politiche coraggiose e innovative.
